TERMS & CONDITIONS

In these booking Terms & Conditions the expressions, “Travel At Leisure” means Travel At Leisure Pty. Ltd. Trading as France at Leisure ABN 87 099 168 537 or associated persons and related employees.
The expression “we”, “our” and “us” include TRAVEL AT LEISURE t/a Travel At Leisure and entities that assist or participate with TRAVEL AT LEISURE in the provision of the services it has agreed to provide.
The expressions “you” (if booking directly with us or through a travel agent) and your travel agent on your behalf (if booking through a travel agent), “your”, “client”, customer” or “passenger”. “your travel agent” include a person seeking or requiring the services offered by TRAVEL AT LEISURE, all other persons (if any) included with that person in the booking and that person’s or those persons’ travel agent (if any).
The expression “service provider” means the party providing the service or services and associated matters to the Customer for the provision of the means the third party entity providing the travel products and services.
Information about travel destinations, airfares, flight times and dates, tours, packages, insurance, rental properties, transfers, timing, itineraries etc. have been supplied to Travel At Leisure by Service Providers and Land Content Providers such as airline companies, hotel representatives, local tourist offices and transport supplier. Travel At Leisure uses reasonable care to ensure the information is correct at the time of quotation but is not liable to the Customer for any inaccuracies.
Travel At Leisure accepts no liability or responsibility for information supplied to it by Service Providers, nor does Travel At Leisure make any warranty or representation regarding the standard of the information. Travel At Leisure recommends that the Customer independently verify all travel service information.
All bookings are subject to the terms and conditions and limitations of liability imposed by the Service Provider. The details of prices, packages, tours, flights and other information provided to the Customer are subject to change without notice. Travel At Leisure reserves the right to vary published prices and charges in the event of fluctuations in the exchange rate or price increases made by the Service Provider.
The Customer is responsible for obtaining all passport, visa and health requirements. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of the relevant immigration and other government authorities at the Customer’s destination will be the Customer’s sole responsibility.
The Customer acknowledges that any dispute in relation to the service at all times remains a matter to be resolved between the Customer and the Service Provider.
SUITABILITY OF TRAVEL PRODUCTS AND SERVICES:
Bookings of all Travel Services we arrange are provided by suppliers we believe to be reputable and to operate in accordance with the standards set down by their own local authorities.
By requesting a quote for or booking any services or products (“Travel Services”), you (if booking directly with us or through a travel agent) and your travel agent on your behalf (if booking through a travel agent) acknowledge and confirm that you have read and agreed to our and service providers booking terms and conditions, that you accept them without reservation as constituting the entire agreement between you and the service provides or us which cannot be varied other than by an officer of TRAVEL AT LEISURE in writing.
Travel At Leisure does not represent to the Customer that any travel products and services recommended to the Customer by Travel At Leisure will be suitable for the Customer. The Customer releases Travel At Leisure from any claims in relation to the travel products and services recommended to the Customer by Travel At Leisure, including but not limited to claims that the travel products and services are not suitable.
Travel At Leisure makes no warranties regarding the safety or otherwise of the Customer’s travel destination. The Customer is to make its own inquiries with the Department of Foreign Affairs and Trade as to the safety and suitability of the Customer’s travel destination.
Suppliers Terms and Conditions
All travel documents will be provided to you by your travel agent or Travel At Leisure prior to departure from Australia. Documents are to be exchanged locally to the relevant supplier. Supply of the Travel Services is made, and all itineraries, coupons and exchange orders (collectively “vouchers”) are issued to you, upon the supplier’s terms and conditions that are then in use, including as to the applicable laws, requirements and policies of any government authority related to, among others, visas, entry, exit or transfer requirements. Your acceptance of the vouchers constitutes those terms and conditions as the entire agreement between you and the relevant supplier and you bear all costs or losses incurred as a consequence of your failure to comply with them.
The Customer acknowledges that the documents once issued to the Customer by Travel At Leisure are non-transferable. The documents include (but are not limited to) airline tickets, hotel and accommodation vouchers, tour vouchers or any other document used to confirm an arrangement with a Service Provider.
The Customer acknowledges that the documents issued to the Customer by Travel At Leisure may also be subject to conditions such as (but not limited to) being non-refundable, non-date changeable, and subject to cancellation or amendment fees.
It is the Customer’s responsibility to read the terms and conditions of the service providers’ brochures and/or attached to the documents issued to the customer by Travel At Leisure.
FAILURE TO PROVIDE SERVICES:
If for any reason the Service Provider is unable to provide the services for which the Customer has contracted, the Customer acknowledges that its remedy lies with the Service Provider and not with Travel At Leisure.

TRAVEL SERVICES LISTED ON WEBSITE.
All Travel Services shown on our website may be booked, subject to availability at the time of booking. Considerable care has been taken to compile the information on our website but circumstances outside of our control may necessitate changes in itineraries or accommodation.
Where it is necessary to change a hotel, we will endeavour to substitute accommodation of no lesser standard.
Prices in this website are valid for travel up to 31st December 2020, unless superseded or otherwise indicated.
You must carefully read and ensure you understand the following terms and conditions.
You must not make any booking unless you understand and agree with the following terms and conditions. We endeavour to ensure the accuracy of all prices displayed on the website.
- (a) based on costs and exchange rates as at the time of publication.
- (b) specified in Australian dollars (unless stated otherwise) and are subject to change without notice;
- (c) indicative only and subject to change until all of your booking details have been provided to us, we have confirmed your booking and you have paid in full; and
- (d) for the number of persons, items or time periods and on the conditions stated on the relevant page of the website, and (e) do not include city taxes which are payable at the time of check- out.
“From” Prices - The expression “from” with respect to a price means the lowest price for the Travel Service we believe is available at the time of publication, based on information we have received from suppliers and exchange rates.
HOTEL DESCRIPTIONS & PHOTOGRAPHS
Hotel and facility descriptions featured on our website are based on hotel guides and information provided by suppliers and may change at any time. Pictures utilised may not reﬂect the exact room, decoration, view or other specifications. Hotel categories indicated as star ratings in this website are listed according to the classifications approved by the Local Authorities of the country where the hotel is located. Therefore, the star ratings may not match the same standards as hotels in Australia or other countries. TRAVEL AT LEISURE is not responsible for any content regarding the description or quality of hotels which is provided on the hotel’s or other websites, and will not be liable for complaints arising from such information. Please note that maps in this website are not to scale and are provided only as a guide to locations.
Pricing and Payment
All written quotes indicate the price for the Travel Services only, they do not, unless specified, indicate the availability of the Travel Services. A quote for Travel Services is valid for 5 days from the date the quote is sent to you. This excludes non-refundable rates.
NON-REFUNDABLE RATES (INSTANT PURCHASE)
Payment for instant purchase product is due immediately by credit card. The booking is subject to availability and the price can change until confirmed. Please call our office immediately after payment.
Travel At Leisure will ask the Customer to pay for the travel products and services provided by the Service Providers. The timing and method of payment depend on the requirements of each Service Provider. The Customer agrees that it will pay Travel At Leisure when requested to do so by Travel At Leisure.
If the Customer fails to pay Travel At Leisure when requested to do so, the Customer acknowledges that the Travel Service Providers may withhold the travel products and services and may cancel any bookings made for the Customer. Any penalties or costs incurred in doing so will be paid by the Customer.
METHODS OF PAYMENT
Payment can be made by Cash, Cheque, Direct deposit or by Credit Card.

Important notice regarding payment options: TRAVEL AT LEISURE, as an AFTA, ATAS and ACS accredited agent would like to advise that, in the eventuality of the service providers used for your travel reservations becoming insolvent or bankrupt, payment made via the TRAVELPAY link (pay.travelpay.com.au/franceal) will guarantee full refund, with the exception of the AFTA and ATAS blacklisted suppliers. Should you decide to settle payments by any other method other than by credit card using TRAVELPAY being cash, direct deposit or other, TRAVEL AT LEISURE will not be in a position to refund any deposits made and losses involved in the eventuality of the service providers becoming insolvent. We therefore strongly recommend our clients to pay all their travel services with TRAVEL PAY, or obtain suitable comprehensive travel insurance to cover potential loss. By settling your next payments, you agree to have acknowledged and agreed to these conditions.
PAYMENT TERMS AND FEES APPLICABLE:
Standard Deposits: A $150.00 deposit per person (non-refundable) is due within 5 working days following the confirmation of booking. In addition, further deposits may be required by the suppliers either in Australia or France. All quotes are subject to change without notice and are subject to availability until full payment is made. Prices are valid for cash or cheque payment only. There is an additional non-refundable 1.9% (incl. GST) merchant fee applicable for payments by credit card.
AMENDMENTS, CANCELLATIONS, PARTIAL CANCELLATIONS AND REFUNDS
All cancellations, partial cancellations or amendments for any Travel Services must be made in writing directly through TRAVEL AT LEISURE or via your travel agent.
Partial cancellation is defined as cancellation of services forming part of an existing booking.
If you cancel your booking after it has been confirmed, but before you utilise the Travel Services, an administration cancellation fees specified below apply.
Amendment: For second and subsequent alterations, an amendment fee of $30 applies on each confirmed bookings.
Cancellation: All cancellations should be made in writing to Travel At Leisure.
The minimum schedule of cancellation fees for most services is as follows:
- 60 Days and more prior to departure from Australia: Forfeit of all Deposit at the time. (Please note that non-refundable services will be subject to total cancellation fees)
- Less than 60 days to 30 days prior departure: 30% of the total cost or deposit, whichever is greater.
- Less than 30 days or less to departure: 100% total cost.
Minimum Booking Fee: $50 applies for bookings made for less than $500 total.
Document Re-issued administration fee: $30 for any amendment made which necessitates re-issuing the documents. This administration fee is in addition to other fees applicable to alterations of confirmed bookings and in addition to other fees applicable by service providers in Australia.
Urgent and late booking fee: $30 administration fee to any booking processed 7 days prior departure date of Australia.
- The price of the Travel Arrangements is subject to the possibility of surcharges.
- Travel At Leisure reserves the right to increase prices until full payment is made - this surcharges may be incurred (without limitation) in connection with:
- currency exchange rates, increases in Product prices, fuel levies, scheduled airfares, hotel, cruise and ground transportation charges, entrance fees and any other increases in connection with the Travel Arrangements.
- Where there is any change in the costs incurred by TRAVEL AT LEISURE in providing the Services, Travel At Leisure may vary its price to account for such change by notifying the Customer, prior the full payment is made.
- Changes in the Australian Dollar – the financial commitments TRAVEL AT LEISURE undertakes in order to offer the prices mean that prices cannot be reduced or refunded if the Australian dollar strengthens.
You are responsible for all immigration, passport, visa, health, quarantine and customs laws, regulations, orders, demands or other requirements of countries visited or transited. You should check the requirements of those countries with their embassies or consulates or other authorities. Official travel advice issued by the Australian Department of Foreign Affairs and Trade is available by calling (in Australia) 1300 555 135 or visiting their website www.dfat.gov.au. We recommend that you review this information both prior to making your booking and prior to departure. We strongly recommend that you also register your upcoming travel plans through the smarttraveller.gov.au site.
Travel insurance is not included in our prices. Travel At Leisure strongly recommends that the Customer take out appropriate travel insurance to protect the Customer against forfeiture of payment, loss of deposits, cancellation charges, baggage loss, medical expenses, theft, any injury, damage, loss, delay, additional expense or inconvenience caused directly or indirectly by force majeure or any other event which is beyond the control of the Customer or which is not preventable by reasonable diligence on the Customer’s part. Travel At Leisure will not be responsible or liable to the Customer for any injury, damage, loss, delay, additional expense or inconvenience suffered by the Customer.
LAW AND JURISDICTION
The agreement between us and you in respect of the services to be provided is constituted solely by these terms and conditions and is governed by the laws of Queensland, Australia. We and you submit to the exclusive jurisdiction of the Courts of Queensland and the Courts of appeal therefrom.
The travel products and services offered and promoted by Travel At Leisure are the products and services of the Service Provider. Travel At Leisure will facilitate the Customer’s travel arrangements, including processing the Customer’s bookings and making payments. Travel At Leisure acts as an agent for the Service Provider. The Customer’s legal relationship in respect of the Service Provider’s products and services is with the Service Provider.
Travel At Leisure, its officer’s employee’s shareholders or other representatives will not be liable for damages or otherwise in connection with the Customer’s use of any products or services supplied, organised or recommended by Travel At Leisure.
To the extent permitted by law, all express and implied warranties, guarantees, representations or terms are expressly excluded. Where the law implies any warranty guarantee or condition which cannot be excluded, our liability to you for breach thereof is limited to supplying the services again or payment of the cost of having the services supplied again. Maximum Liability Despite any other provision of these terms and conditions, to the extent permitted by law, our maximum liability to you or any third party is limited to the price you have paid us for the booking.
We endeavour to ensure that the arrangements we have made for you are implemented as arranged. If a problem occurs, the most practical way to deal with it is to attempt resolution locally with the supplier. If you fail to follow this course, any claim for compensation may be reduced or denied. If you have any unresolved complaint, details should be lodged in writing (with supporting documentation, including efforts made with the supplier to resolve it) with your travel agent or directly with us within 20 days of your trip concluding. No claim made after this period will be considered.
